KFC OFFER TERMS AND CONDITIONS
1. This offer (“Offer”) is made by Kentucky Fried Chicken Pty Ltd (ABN 79 000 587 780) and KFC Adco Limited (ABN 22 083 047 992) of 20 Rodborough Road, Frenchs Forest NSW 2086 (“Promoter”).
2. Offer available only to “Eligible Claimants”. An "Eligible Claimant" is an individual who: (i) is a resident of Australia; (ii) has a current Facebook account; (iii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Offer; (iv) is not an employee of a KFC franchisee; and (v) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
3. Offer commences at Wednesday 23rd April 2014 and closes at 23:59pm Thursday 24th April 2014 or one the first 10,000 coupon claims have been received, whichever occurs first (“Offer Period”). All times and dates specified in these terms and conditions are times and dates in Sydney.
4. Subject to these terms and conditions, an Eligible Claimant who, during the Offer Period:
(i) “Like” the KFC Australia Facebook page; and
(ii) by registering his/her claim ("Claim") as directed (“Successful Claimant”) will be awarded one coupon ("Coupon").
5. A Successful Claimant will be provided with a Coupon containing a unique code by email sent to the Successful Claimant’s email address as provided in their Claim.
6. Subject to any applicable conditions, each Coupon can be redeemed for One Regular Twister ("Product"). Each Product is valued at $6.95 and the Coupon must be redeemed by 23:59 AEST Thursday 24th April 2014(“Expiry Date”). Limit of one Coupon and Product per Eligible Claimant, not to be used in conjunction with any other offer. Maximum One Coupons and Products to be awarded to Eligible Claimants.
7. To redeem the Product, a Successful Claimant must separately, no later than the Expiry Date:
(i) surrender the Coupon to a KFC staff member in store at a counter register; and
8. By registering a Claim, a claimant is deemed to have accepted these terms and conditions.
9. Redemption of the Coupon is subject to any specified conditions. The Promoter accepts no responsibility if the Coupon is stolen, forged, lost or tampered with anyway. Each Coupon is not transferable and cannot be redeemed for cash.
10. FACEBOOK:
(i) The Offer is in no way sponsored, endorsed or administered by, or associated with, Facebook.
(ii) By participating in the Offer, each claimant releases Facebook, Inc from any and all liability to the claimant arising in any way from the conduct of the Offer.
(iii) All information provided by a claimant in relation to the Offer is provided to the Promoter and not to Facebook.
11. The Promoter and KFC Franchisees reserve the right, in their absolute discretion, to verify the validity of all Claims (including the right to confirm and verify the identity of a claimant, by requesting proof of identity and proof of residency. Identification considered suitable is at the Promoter's absolute discretion) and to not accept any Claim from a claimant who, in the Promoter’s or KFC Franchisee's opinion, has tampered with the Claim process or submitted a Claim that is not in accordance with these conditions.
12. Nothing in these terms and conditions, limits, excludes or modifies the statutory consumer guarantees as provided under the Australian Consumer Law (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, its related corporations, KFC Franchisees, and prize suppliers (including their respective officers, employees and agents) ["Relevant Parties"] excludeall liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Offer.
13. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Relevant Parties are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim, Coupon, Product that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Product value to that stated in these terms and conditions; (e) any tax liability incurred by a claimant; or (f) use of the Product.
14. If the Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the Offer.
15. If any provision of these terms and conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
16. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS OFFER OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
17. Claimant personal information will be collected by or on behalf of the Promoter to enable it to administer the Offer and, if a claimant consents, may be used to market its products to the claimant. The personal information of the claimants may be provided to others assisting in the conduct of the Offer, including the supplier and deliverer of the Gift. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a claimant does not provide accurate personal information the Promoter may determine that they are not eligible to be awarded a Gift.
